By accessing or using the TovTam website or mobile application, you confirm that you have read, understood, and agreed to these Terms and Conditions.  

If you do not agree to these Terms, you must stop using our services immediately.

4. Eligibility  
You must be at least 13 years old (or the minimum age required in your country of residence) to use TovTam. By using the services, you represent and warrant that you meet this age requirement.

TovTam provides general information about tourism destinations, including short descriptions, historical context, photos, videos, and map locations.

5A. License to Use 
Subject to your acceptance of these Terms, TovTam grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the TovTam services solely for your personal, non-commercial travel and tourism information purposes.

This license does not permit you to copy, reproduce, modify, distribute, create derivative works from, or commercially exploit any content. We reserve the right to revoke this license at any time if you violate these Terms.

6. Disclaimer of Warranties 
The TovTam services and all content (including descriptions, historical information, photos, videos, and map locations) are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, TovTam makes no representations or warranties, express or implied, regarding:  

  • The accuracy, completeness, timeliness, or reliability of any information;  
  • The suitability of the content for any travel purpose;  
  • That the website or app will be uninterrupted, error-free, secure, or free from viruses or harmful components.

You use TovTam entirely at your own risk. Any reliance on the content is strictly your responsibility.

7. Limitation of Liability 
To the fullest extent permitted by Cambodian law, TovTam, its owners, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the services. This includes, without limitation:  

  • Any travel decisions, losses, injuries, or damages suffered based on information obtained from TovTam;  
  • Errors or omissions in content, maps, or third-party information;  
  • Technical issues, interruptions, or security breaches.

In no event shall our total liability to you exceed the amount you paid to us (if any) in the twelve (12) months prior to the claim. Since the services are currently provided free of charge, our liability is limited to the maximum extent allowed by law.

8. Changes to These Terms  
We may update or modify these Terms at any time when necessary. Your continued use of TovTam after the updated Terms are posted means you accept the changes. We will try to provide reasonable notice for major changes.

9. Changes, Suspension, or Withdrawal of Services  
TovTam services are currently provided free of charge. We do not guarantee uninterrupted or always-available access. We may suspend, withdraw, or restrict all or part of the services at any time, with or without prior notice, for operational, legal, security, or technical reasons.

Force Majeure  
TovTam shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, government actions, pandemics, or internet failures.

All content and materials on TovTam, including text, images, videos, software, trademarks, design, and database rights, are owned by TovTam or licensed to us. All rights are reserved.

You may not copy, reproduce, distribute, modify, or commercially use our content without prior written permission.

11. Security and Prohibited Use  
We do not guarantee that the website or app will always be secure or free from bugs or viruses. You are responsible for protecting your own device with appropriate antivirus and security software.

You must not:  

  • Introduce malicious code (viruses, worms, trojans, logic bombs, etc.);  
  • Attempt unauthorized access to our systems, servers, or databases;  
  • Interfere with the normal operation of TovTam (including denial-of-service attacks);  
  • Scrape, mine, or systematically extract data from the services.

12. User-Generated Content (UGC) Safety and Moderation

12.1 Terms Before UGC Access  
You must accept these Terms before accessing or contributing any user-generated content.

12.2 Filtering Objectionable Content  
We use automated and manual moderation to detect and limit objectionable content, including harassment, hate speech, sexual content, violence, and spam.

12.3 Reporting Mechanism  
You can flag objectionable content using in-app reporting tools. All reports are recorded for review.

12.4 Blocking Mechanism  
You can block abusive users. When blocked, the user’s content is immediately removed from your view, and the action may notify our moderation team.

12.5 24-Hour Enforcement Commitment  
We aim to act on valid reports within 24 hours. Confirmed violations may result in content removal and suspension, restriction, or termination of the offending account.

12.6 Indemnification  
You agree to indemnify, defend, and hold harmless TovTam, its owners, employees, and affiliates from any claims, damages, losses, costs, and expenses (including legal fees) arising from:  

  • Your use of the services;  
  • Any user-generated content you post;  
  • Your violation of these Terms or applicable law;  
  • Any infringement of third-party rights caused by your actions or content.

This obligation continues even after you stop using TovTam.

14. Privacy 
We are committed to protecting your privacy. Personal data collected through TovTam is processed in accordance with our Privacy Policy (available on the app/website).

15. Language 
These Terms may be translated into other languages for convenience. In the event of any inconsistency between versions, the Khmer version prevails.

16. Governing Law and Jurisdiction  
These Terms are governed by the laws of the Kingdom of Cambodia. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Cambodian courts.
